These terms and conditions govern the provision of metal fabrication and welding services by YT Metal Fabrication in accordance with Victorian and Australian law.

Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "Client", "you") and YT Metal Fabrication (ABN: [ABN Number]) ("Company", "we", "us", "our") regarding the provision of metal fabrication and welding services.
By engaging our services, requesting quotes, or entering into any agreement with us, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws of Victoria, Australia.
Our business operates from 3/29 Central Avenue, Sunshine, VIC 3020, and is governed by Australian Consumer Law, Victorian building regulations, and relevant industry standards.
Services Provided
YT Metal Fabrication provides the following services:
- Custom truck trailer fabrication and design
- Professional welding services (MIG, TIG, Stick)
- Truck trailer repairs and maintenance
- Mobile welding and on-site services
- Pressure vessel welding (ticketed)
- Structural steel fabrication
- Gates, fencing, and security fabrication
- General metal fabrication and repairs
All services are provided in accordance with Australian Standards, Victorian building codes, and relevant industry regulations. We reserve the right to refuse service for projects outside our expertise or legal compliance requirements.
Quotes and Pricing
Quotes: All quotes are provided free of charge and are valid for 30 days unless otherwise specified. Quotes are estimates based on information provided and may be subject to variation upon inspection or discovery of additional work required.
Pricing: Prices include materials, labor, and standard delivery within our service area. Additional charges may apply for:
- Urgent or after-hours work
- Delivery outside standard service area
- Specialized materials or equipment
- Engineering or design services
- Permit applications and approvals
All prices are in Australian Dollars (AUD) and include GST where applicable.
Payment Terms
Payment Schedule:
- Small jobs (under $2,000): Full payment on completion
- Medium jobs ($2,000-$10,000): 50% deposit, balance on completion
- Large projects (over $10,000): 30% deposit, progress payments as agreed
Payment Methods: We accept cash, bank transfer, credit cards, and business cheques. Payment terms are 7 days from invoice date unless otherwise agreed in writing.
Warranties and Guarantees
Workmanship Warranty: We warrant our workmanship for 12 months from completion date against defects in materials and workmanship under normal use and conditions.
Materials Warranty: Materials are warranted according to manufacturer specifications. We will pass on any manufacturer warranties to the customer.
Warranty Exclusions: Warranties do not cover:
- Normal wear and tear
- Damage from misuse, abuse, or negligence
- Modifications by others
- Damage from accidents or natural disasters
- Failure to follow maintenance recommendations
Our warranties are in addition to your rights under Australian Consumer Law, which cannot be excluded.
Liability and Insurance
Public Liability: We maintain public liability insurance of $10 million and professional indemnity insurance as required by Victorian law.
Limitation of Liability: To the extent permitted by law, our liability is limited to the cost of re-performing the defective work or refunding the amount paid for such work.
Customer Responsibilities: Customers are responsible for:
- Providing accurate project specifications
- Ensuring site access and safety
- Obtaining necessary permits (unless agreed otherwise)
- Compliance with local council requirements
- Proper maintenance of completed work
Intellectual Property
Custom Designs: Any custom designs, drawings, or specifications created by us remain our intellectual property unless specifically transferred in writing.
Customer Designs: Customers warrant they have the right to use any designs, specifications, or materials they provide and indemnify us against any intellectual property claims.
Photography: We may photograph completed work for marketing purposes unless the customer objects in writing.
Cancellation and Termination
Customer Cancellation: Customers may cancel orders before work commences with 48 hours written notice. Cancellation after work has commenced may incur charges for work completed and materials ordered.
Company Termination: We may terminate services for non-payment, breach of terms, or safety concerns. In such cases, payment is due for work completed to date.
Force Majeure: Neither party is liable for delays or failures due to circumstances beyond reasonable control, including natural disasters, government actions, or supply chain disruptions.
Dispute Resolution
Initial Resolution: We encourage customers to contact us directly to resolve any concerns. We are committed to fair and prompt resolution of disputes.
Mediation: If direct negotiation fails, disputes may be referred to mediation through the Victorian Civil and Administrative Tribunal (VCAT) or another agreed mediator.
Governing Law: These terms are governed by Victorian and Australian law. Any legal proceedings must be commenced in Victorian courts.
General Provisions
Entire Agreement: These terms, together with any written quote or contract, constitute the entire agreement between parties.
Modifications: Changes to these terms must be agreed in writing and signed by both parties.
Severability: If any provision is found invalid, the remainder of these terms remains in effect.
Privacy: Personal information is handled in accordance with our Privacy Policy and Australian Privacy Principles.
